The toys are designed in such a way that you can't have two of the same molds as legs at the same time. You could do it, but the legs would just be touching each other, or he would be at an awkward stance.
For example. if you have two tanks, the part of the leg near the knee would touch one another. If you have 2 helicopters, the part near the feet, such as the wings, would touch one another, and get in the way.
Same thing with superion maximus. The A-10's are wider at the knees, and the F-22's are wider near the feet. So to make it fit, the A-10 and F-22 both have to be feet so it could fit.
Constructicon maximus is a bit different. Haven't combined him yet, but I think that having 2 front end loaders as feet would mean the same thing as what the tanks do in bruticus maximus, and that the crane has to be the left arm because the shovel from the excavator gets in the way.
I want to see how you combine your 3 maximus combiners, without the use of appendage kits, and do you feel that if you put 2 of the same mold as legs, that the legs touch one another more so than having one mold and the other mold?
I think that is why the default positions for the maximus combiners is the whole diagonal thing, and that the legs consists of 2 different molds.
