he is LEGAL to sell and import into Canada, and even show photos of, as Canadian law does not consider it direct tobacco advertising.

It has nothing to do with tobacco advertising but rather a trademark issue in the US: the deco. on MP-23 has infringed the Marlboro trademark even though TakaraTomy has made small changes to try to resolve the issue. The trademark holder Phillip Morris USA does not approved anyone to sell MP-23 in the US because they claimed the small changes are not good enough such that people may have been confused by the deco. on the figure with the Marlboro brand.
Don't know if this has any ramification here but I have noticed that a couple of Canadian sellers like Automaton have removed the preorder.

I believe you are correct sir - the copyright issue only applies to retailers advertising/selling it. Individuals can still import and buy it.

thats not where i have my order in with, but there is no other word from either my shop or ebay purchase.

I feel like this is the single best thing that could happen to this repaint... Of course there were many who already wanted it due to it being a numbered MP or because they like marlboro/diaclone wheeljack but now so many people have it on their radar due to all this extra publicity.
