Except the seller never claimed to be passing it off as official. He can certainly pass it off as real, because the toy is real, it exists.

There is a reason why seller use code words like Asian for KO, because sometimes their auction are removed for having the work KO in them. They WANT to be honest as a seller, but not have their auction removed either. So they say it's the Asian version, and put a picture of the KO, hoping the buyer can see the writing on the wall.

Often times Chinese sellers refer to their toys as "homeland versions" of toys, which means they were made by Chinese companies (aka KO makers).
