IMO, both parties are at fault based on what has been said about how things have transpired.
I think it's pretty clear that Warbotron did not initially plan for BBTS to have exclusive rights for 90 days. IF they had, then this information should have been made available to all distributors and retailers long before. Therefore, they are certainly in the wrong for changing the rules of the game this late in the release. If what people say are true in that their initial production run was lower than expected, that does not excuse them for changing the allocation of their product.
I understand why BBTS did what they did, as it's a win win from a sales standpoint for both parties. Also, although such an action might not sit well with many, most people who still want one will probably still go ahead and buy from BBTS.
Not to mention they don't just sell Transformers. They have several different lines of toys that generates revenue and even if a few people decide not to order from them again, the overall effect might not be of any significance, especially if other 3rd party companies follow suit and produce more exclusive figures.
That said, I for one will not be buying it. I've purchased from BBTS before and have had a couple issues with them where the resolution was not to my satisfaction as customer service stands. Warbotron was a purchase that I would have only picked up if obtained locally from Slayback. If he's not getting it then I guess I won't be either and that's fine with me.
