To be fair, I think that's more a matter of poor writing/directing than anything else. Yes, the autobots (and Prime in particular) are jarringly violent and brutal, but I think that's the result of making a summer popcorn flick with lots of big robots and bigger explosions.

Another problem is that we are given very little to no insight (in the movies themselves, at least) to who these characters were on Cybertron.

I just assume that Demolishor was executed the way he was because he was a brutal killing machine that may have been beyond rehabilitation and did who knows how many unspeakable things before he came to Earth. Also, where would you keep a prisoner that size? And since these are robots that could live for millions of years, imprisonment doesn't seem like too much of a punishment or practical deterrent to me.

The movies also don't give us any idea of how crime and punishment would be handled by a race of giant robots. I'm sure there would be differences based on the fact that we're organic and they're robotic.

But in the end, I don't think too hard about the movies. :P

Honestly, I didn't find much difference between the Autobots and the Decepticons in the Bayverse. Both are brutally violent, and both don't consider Humans to be that important (with the exception of Optimus Prime and Bumblebee).

My reasoning for this is when in the first movie Ironhide wants to eliminate the parents.

Also, Optimus keeps mentioning that Earth is their new home. Not that they are refugees, that they are living here.

I have to say that while the Decepticons have always been said to be evil, what I saw and read in the movies and comics was Megatron's rise to free his people from slavery and then when their planet has been devastated, he spends his time working to rebuilding their world and nursing younglings.

Prime on the otherhand has abandoned their homeworld and if the end of TF3 is proof, the Autobots sacrificed their own planet to save some random backwater world that had just betrayed them to the Decepticons. Killing hundreds of Transformers on Earth and countless more on Cybertron. The Autobots are actually responsible for one of the greatest genocides in their history.
