There should be no debate. Even if we ignore that his fees and penalties are legally questionable even on relevant orders themselves, him skimming refund money off of one order to cover a fee he didn't get to collect off another one is scummy to the extreme.
The credit card company/paypal gave you your money back because he violated the terms of the contract that was your purchase. He was in the wrong and in the process forfeits his claim to money coming from penalizing you. That doesn't give him the right to turn around and take it off
another unrelated order. Nothing does.
This is the kind of disreputable BS that he needs to be called on the carpet for, otherwise he's going to take it as license to be able to do it again to others
